FSSAI Licensing is a crucial step for any food business operator (FBO) in India who wants to legally manufacture, distribute, and sell food products within the country. The Food Safety and Standards Authority of India (FSSAI) is responsible for regulating and supervising food safety and standards in India. FSSAI issues licenses to food businesses to ensure that they adhere to the necessary food safety regulations set under the Food Safety and Standards Act, 2006.

FSSAI Licensing is a mandatory process for all food business operators, and failure to comply can result in penalties, product recalls, or even the shutdown of the business.

There are three primary categories of FSSAI licenses, based on the size and scale of the food business:

  1. FSSAI Registration (Basic Registration):
    • For Small-scale Businesses: This license is for small food businesses with annual turnover up to ₹12 lakhs. It is ideal for small manufacturers, retailers, and wholesalers.
    • Applicability: Includes small-scale food retailers, food stalls, small catering units, etc.
    • Documents Required: Basic business details, identity proof, and address proof of the business owner.
  2. FSSAI State License:
    • For Medium-scale Businesses: This license is applicable for businesses with an annual turnover between ₹12 lakhs and ₹20 crores. It is suitable for food manufacturers, processors, and suppliers who have moderate production and distribution volumes.
    • Applicability: Includes mid-sized food processing units, restaurants, distributors, and manufacturers operating at a state level.
    • Documents Required: Business details, food safety management system plans, and additional documentation related to production or service.
  3. FSSAI Central License:
    • For Large-scale Businesses: This license is meant for businesses with an annual turnover exceeding ₹20 crores or those involved in large-scale manufacturing or import/export of food products.
    • Applicability: Includes large food processing plants, exporters, importers, large-scale caterers, and major food retailers.
    • Documents Required: Similar to the state license but with additional regulatory requirements for larger operations, such as factory layout, production process, etc.

 

FSSAI licensing is mandatory for all food business operators involved in any of the following activities:

  1. Manufacturing:
    • Any business that manufactures food products for sale, including food processors, packers, and bottlers.
  2. Importing and Exporting:
    • Businesses involved in importing or exporting food products need FSSAI licensing to ensure that their products comply with Indian food safety regulations.
  3. Food Retailing:
    • Retailers, including supermarkets, food stalls, grocery stores, and online food retailers, must obtain FSSAI licenses to sell food products.
  4. Food Service and Catering:
    • Restaurants, cafes, food delivery services, and caterers must obtain a license to operate legally.
  5. Storage and Distribution:
    • Businesses involved in the storage, distribution, and transportation of food products, including warehouses and cold storage facilities, need FSSAI licensing.

The process for obtaining an FSSAI license varies depending on the type of license required. Below is the general process:

  1. Determine the Type of License:
  • First, determine whether your business qualifies for basic registration, a state license, or a central license based on its size, scale of operations, and annual turnover.
  1. Create an Account:
  • Visit the official FSSAI website and create an account on the Food Safety Compliance System (FoSCoS) portal.
  1. Fill in the Application:
  • Complete the online application form with all required details, including business name, address, type of food business, and details of the responsible person.
  1. Submit Required Documents:
  • Submit the necessary documents, which may include identity proof, business proof, food safety management system (FSMS) plan, layout plans of the premises, and relevant certifications.
  1. Pay the Application Fee:
  • Pay the prescribed fee for the license, which varies depending on the type of business and the scale of operations.
  1. Verification and Inspection:
  • After the application is submitted, FSSAI may conduct a physical inspection of the premises (in the case of state and central licenses) to ensure compliance with safety and sanitation standards.
  1. Issuance of License:
    • Once the inspection is completed successfully, and the documents are verified, FSSAI will issue the license to the business. The license will contain details like the business name, license number, type of license, and the validity period.

The documents required may vary depending on the size and type of the business. However, the general list includes:

  • Identity Proof of the applicant (e.g., Aadhaar card, passport).
  • Address Proof of the business (e.g., rent agreement, utility bill).
  • Business Registration Proof (e.g., shop establishment certificate, partnership deed).
  • Food Safety Management Plan (if applicable) outlining safety measures and protocols.
  • Premises Layout Plan (for manufacturing units).
  • List of Food Products manufactured or handled.
  • NOC from the local municipal authority (for food establishments).
  • Declaration of Food Business Operator confirming adherence to safety norms.
  • Basic Registration: Typically valid for 1-5 years.
  • State License: Valid for 1-5 years, depending on the business.
  • Central License: Valid for 1-5 years.

The validity of the FSSAI license will depend on the type of business and its scale of operation. Renewal applications should be submitted well before the expiry date to avoid any disruption in business operations.

  1. Legal Operation:
    • FSSAI licensing ensures that businesses comply with food safety laws and can legally operate in India. Without the license, businesses may face legal penalties, product bans, or closure.
  2. Consumer Confidence:
    • The FSSAI logo on food packaging assures consumers that the product meets Indian food safety standards and is safe for consumption.
  3. Access to Market:
    • FSSAI licensed businesses are recognized by retailers and suppliers. Many retailers, especially large chains, only accept food products from FSSAI-licensed suppliers.
  4. Quality Assurance:
    • FSSAI licensing demonstrates that a business adheres to strict food safety and quality standards. This helps in ensuring consistent quality and safety of food products.
  5. Reduced Risk of Recalls:
    • Licensing reduces the risk of food safety issues and recalls by ensuring that food businesses follow proper hygiene, safety, and quality control procedures.
  6. Trust and Credibility:
    • An FSSAI license boosts the credibility of a food business by showing its commitment to food safety and regulatory compliance, enhancing consumer trust.

FSSAI licenses are typically issued for a period of 1-5 years, depending on the business type. To continue operations, businesses must renew their license before it expires. The renewal process is similar to the application process and involves submitting an application and paying the renewal fee. Renewal should be done at least 30 days before the expiration date.
